Does a minimum commitment or a binding period apply?
No minimum commitment applies, unless agreed as a condition for a reduced price.
I am also happy to assist with smaller assignments on an ad hoc-basis.
On long-term engagements, the notice of termination is 30 days plus the current month. On short-term engagements, a reduced notice period can be agreed upon.
Is it possible to agree on a fixed price for a project instead of an hourly rate?
As a general rule, the price for my services is based on an hourly rate which varies depending on the scope of the project and the time frame involved. The principle is that the more hours you book, the lower the hourly rate. If a project requires that I (more than occasionally) work outside of normal working hours, the hourly rate will be higher than if the project can be completed within normal working hours.
For certain types of projects, I may (depending on the specific circumstances, including duration, complexity etc.) be able to offer a fixed monthly price or a total price for the defined project.
What are the payment terms?
You will be invoiced on a monthly basis and after completion of a project.
All prices referred to in offers, contracts, invoices, etc. exclude VAT which will be added in accordance with applicable rules.
Are there any practical matters to be particularly aware of when engaging you on a project?
My experience is that clients typically get the best outcome from working with me if I work on-site (at least for part of the time), as this allows me to meet the team and the relevant stakeholders in the organisation that I will assist, in person. If this is the case, obviously, you will need to arrange for an office space, a PC with access to relevant systems, an access card, etc.
Additionally, to ensure efficiency from day one, it is important that an internal resource is allocated to onboard me on the assignment and to be available for clarifying questions during the project. I usually easily adapt to a new organisation and quickly identify legal issues, but there will always be a need for alignment and partial reporting during a project.
What if a need for support outside of your expertise arises?
I only take on assignments that I consider myself qualified to perform. I will always discuss and align expectations with you as a client regarding the required specialisation, time frame, etc. involved with the assignment before entering an engagement. There are areas that I am not able to assist with. As an example, I do not advise on tax law matters. There are also tasks that are better suited to being handled by a law firm. I will always advise you on this when you present an assignment to me.
Through my cooperation with a law firm and network in the industry in general, I can quickly facilitate engagement of other specialists if a task which is outside of my expertise or requires a team effort, arises.
What are the implications for us as a client that you do not have an active attorney’s license?
I obtained my attorney’s license in 2007 after three years as a junior asscociate at the law firm Plesner and completion of the mandatory legal trainee program.
In January 2023, I deposited my attorney's license in connection with leaving my position as Attorney and Associate Partner at Accura to enter the legal consultancy industry. When providing legal advice as a legal consultant, there is neither a legal requirement nor a practical need for an active attorney's license.
For you as a client, the only practical implication is that I cannot represent you in court cases. Further, I am not subject to the code of conduct for lawyers (De Advokatetiske Regler), which are ethical standards that apply to lawyers' conduct, although in practice, I follow many of the principles even though they do not directly apply. This includes rules on conflicts of interest, confidentiality duties, the restrictions on accepting assignments without possessing the requisite skills or expertise, etc.
The professional standards of my legal services remain the same as if I had held an active attorney’s license. My services are covered by professional liability insurance comparable to that of an attorney.
What are the advantages of engaging you instead of a lawyer seconded from a law firm?
Besides my eight years’ experience practicing as a lawyer in law firms, I have extensive experience working as an in-house lawyer, both as an employee and a consultant. I therefore understand what it means to support as an in-house lawyer as opposed to advising from an external lawyer perspective.
Through my experience as in-house lawyer, I have learned that legal solutions must be practical and that other interests than legal considerations are at play when choosing a solution.
I acknowledge and address the importance of knowledge sharing and as such ensure a thorough handover when a project is completed.
Through my collaboration with a law firm, I stay updated on the latest market practices and maintain a network of skilled specialists. Finally, I can typically be engaged on tasks at short notice and without minimum commitment.
My pricing is advantageous and flexible.
What about insurance?
I have professional liability insurance through ADIS / HDI Specialty, which covers the liability associated with my legal consultancy services.
